Since 2006, under legislation enacted by the North Carolina Legislature, the AAA has administered this mediation program for certain property insurance claims resulting from a disaster. The program provides a non-adversarial mediation process to facilitate the effective, fair, and timely resolution of disputed residential property insurance claims arising out of damages caused by declared disasters.
The AAA works with the North Carolina Department of Insurance to ensure that this program—available to first-party claimants after a state of disaster has been proclaimed by the Governor or declared by the President for all of North Carolina or for an area within the state—is maintained in the necessary state of readiness. To date, the settlement rate of claims is 75%
According to North Carolina General Statutes §58-44-70 thru §58-44-120, mediators participating in the North Carolina Disaster Mediation Program must be certified by the Dispute Resolution Commission under G.S. 7A-38.2. Click here to see the AAA Mediators Model Standards of Conduct.
